Terms of Service

1. Agreement

These Terms of Service form an agreement between you and Paper Hare (“Paper Hare,” “we,” “us,” or “our”). They apply to your use of this website and any related Paper Hare storefront pages, and to every order placed through the store. By using the store or placing an order, you agree to these terms, our Privacy Policy, and our Shipping & Returns policy.

2. Our products

Paper Hare sells ready-made wrapping-paper designs to retail customers in Canada and the United States. They are not offered for personalization, custom print runs, resale, or wholesale through this store.

Product photography and your screen settings can affect how colours, patterns, and finishes appear. Minor differences between a product image and the delivered product are not defects by themselves. Product details, availability, and prices may change without notice, but changes will not affect an order that we have already accepted unless the change is required by law or agreed with you.

3. Eligibility and accounts

You must be legally able to enter into a binding contract where you live to use the store or place an order. If you create an account, you must provide accurate information, keep your sign-in details confidential, and tell us promptly if you believe your account has been accessed without permission. You are responsible for activity carried out through your account unless it resulted from our failure to use reasonable security measures.

4. Orders and acceptance

Placing an order is an offer to buy the products shown in your cart. We will send an order confirmation when we receive your order, but that confirmation does not by itself mean that the order has been accepted. An order is accepted only when payment is confirmed and we are able to fulfill it.

We may refuse or cancel an order where a product is unavailable, a price or listing error occurred, payment cannot be verified, the delivery information is incomplete, fraud or abuse is suspected, or fulfillment is not available for the delivery address. If we cancel after payment, we will return the amount paid for the cancelled order to the original payment method.

5. Prices, taxes, and payment

Prices are shown in USD. Applicable sales taxes are calculated and added at checkout where required. Standard shipping is included in the product price for eligible addresses in Canada and the United States; any different shipping charge or restriction will be shown before you submit your order.

Payments are processed by our payment provider. You authorize the provider to charge the payment method you select for the total shown at checkout. We do not receive or store your complete payment-card number. Promotional codes are subject to their stated conditions, may be limited to one per order, and have no cash value unless required by law.

6. Shipping and delivery

We ship to addresses in Canada and the United States. Delivery estimates and tracking information are described in our Shipping & Returns policy and in order emails. Estimates are not guarantees. Carrier delays, weather, customs, incorrect addresses, and events outside our reasonable control can affect delivery.

You are responsible for reviewing your delivery address before submitting an order. Contact us as soon as possible if an address is wrong. We may not be able to change an address after production or shipment begins, and we are not responsible for delivery problems caused by an address you provided incorrectly.

7. Final sale and order problems

Purchases are final sale. We do not offer returns, exchanges, or refunds for change of mind, sizing preference, colour preference, or other reasons unrelated to a problem with the order. Our support team may review an individual situation, but any discretionary exception is not a promise or a change to this policy.

If an order arrives damaged, defective, materially different from what you ordered, or incorrect, contact us through our contact page promptly with your order number and clear photographs of the packaging, shipping label, and affected product. We will review the issue and provide the resolution required by applicable law or the appropriate resolution under our Shipping & Returns policy.

Nothing in these terms removes or limits a consumer right, remedy, warranty, or cancellation right that cannot lawfully be excluded or limited where you live.

8. Permitted use of the store

You may use the store only for lawful personal shopping and account purposes. You must not:

• use the store to violate a law, regulation, or third-party right;
• submit false information, impersonate another person, or interfere with another customer’s account;
• attempt to bypass security, probe or damage the store, introduce malicious code, or interfere with its availability;
• scrape, copy, reproduce, resell, or commercially exploit store content without our written permission; or
• use automated systems to access the store in a way that places an unreasonable load on it or defeats access controls.

We may suspend or end access to the store or an account if these terms are breached, if access creates a security or operational risk, or if we are required to do so by law.

9. Ownership of store content

The Paper Hare name, logo, artwork, product imagery, photographs, text, layout, and other store content are owned by or licensed to Paper Hare and are protected by applicable intellectual-property laws. We give you a limited, revocable, non-exclusive right to access the store for personal, non-commercial use. No other licence is granted. You must obtain our written permission before copying, modifying, distributing, displaying, publishing, selling, or using our content commercially.

10. Third-party services

The store relies on third-party services for payment processing, hosting, email, fulfillment, delivery, security, and related operations. Those services may have their own terms and privacy policies. We are not responsible for a third party’s independent systems or conduct, but we remain responsible for our obligations to you under applicable law and these terms.

11. Privacy and electronic communications

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the store, you agree that we may communicate with you electronically about orders, accounts, service messages, security, and support. Electronic notices satisfy legal writing requirements where the law permits.

12. Disclaimers

To the maximum extent permitted by law, the store and its content are provided on an “as available” basis. We do not promise that the store will always be uninterrupted, error-free, or free of harmful code, or that every product will remain available. We do not exclude any express warranty, implied warranty, condition, or guarantee that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Paper Hare and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, revenue, profit, or opportunity arising from your use of the store or a product. Where liability cannot be excluded, our total liability for a claim relating to an order will not exceed the amount you paid for that order, except to the extent a different limit is required by applicable law.

14. Indemnity

To the extent permitted by law, you agree to reimburse Paper Hare for reasonable losses, claims, and costs arising from your material breach of these terms, your misuse of the store, or your violation of another person’s rights. This obligation does not apply to the extent a claim was caused by our own breach, negligence, or unlawful conduct.

15. Changes to these terms

We may update these terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Changes apply from the date they are posted and do not change the terms that applied to an order already accepted, unless the change is required by law or agreed with you. If a change is material, we may provide additional notice where appropriate.

16. General terms

If a provision of these terms is found unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these terms without our written consent. We may transfer our rights and obligations as part of a business transfer, reorganization, or sale, subject to applicable law. These terms and the policies linked in them are the entire agreement between you and Paper Hare about the store, except for any additional written terms that apply to a specific order.

17. Governing law and contact

These terms are governed by the laws that apply to your transaction and relationship with Paper Hare. Courts with proper jurisdiction will have authority over disputes, subject to any mandatory consumer rights that apply where you live.
